Immigration Assistance (Updated to Reflect 1 July 2024 Changes)
The Department of Home Affairs now directly oversees the regulation and registration of migration agents in Australia.
Who Can Provide Immigration Assistance?
Under the Migration Act 1958, immigration assistance may only be provided by individuals who are registered migration agents, as listed on the register maintained by the Department of Home Affairs, unless an exemption applies. Providing immigration assistance without proper registration is a criminal offence.
Education agents are not exempt persons and must not provide immigration assistance of any kind—including assistance with student visa applications—unless they are also Registered Migration Agents.
A current and authoritative list of Registered Migration Agents is available through the Department of Home Affairs.
Activities Not Considered Immigration Assistance
The following actions are not regarded as immigration assistance:
-
Performing clerical work to help prepare an application or document
-
Providing translation or interpretation to assist with an application
-
Advising a person that they must apply for a visa (without offering further immigration advice)
-
Passing on information from a third party without substantial interpretation or explanation
Education agents who are also Registered Migration Agents may legally provide immigration assistance.
